Question 1 :
Do I need to register my online business which deals with setting up websites for companies to sell their products? If yes, will the business have to be registered as a limited liability company. What are the licence requirements?
 
Reply :
All online businesses must be registered. The business can either be registered as:
  • A sole trader or partnership under the Registration of Businesses Act 1956 (ROBA); OR
  • Incorporate a limited liability company as a vehicle to carry on the business.
If you choose to register under ROBA, you can do so yourself by visiting the Companies Commission of Malaysia 's (SSM) website and access SSM's e-lodgment service.
If you choose to incorporate a company, you are advised to seek the services of a company secretary who can also perform the incorporation process online via SSM's e-lodgement service on your behalf.
Licence requirements will depend on the type of goods or services you wish to offer online and are subjected to requirements of the relevant authorities
