  • PEMUDAH’s scope of work consist of 3 based elements:

    1. To facilitate businesses in Malaysia by identifying improvements to existing Government processes and regulations, based on public feedback and global benchmarking reports;

    2. To oversee the implementation of identified improvements; and

    3. To recommend business-related policy changes to the Cabinet, based on public feedback.

  • PEMUDAH helps to address and resolve government policy-related issues that affect business efficiency, productivity, growth, sustainability and competitiveness as well as government regulation-related operational issues that cause or increase unnecessary regulatory burden on the doing of business in terms of the number of procedures, transactional time and costs in regulatory processes.

  • Issues are to be submitted online through the Unified Public Consultation Portal (UPC) to the MalaysiaMudah (#MyMudah) public consultation platform and the #MyMudah Secretariat will determine on the appropriateness for action to be taken on issues whether to channel an issue to PEMUDAH or to a government ministry or agency having jurisdiction over the issue. Companies and business enterprises that are members of trade or industry associations can first refer to their associations to ascertain whether their associations operate an in-house #MyMudah Unit which can assist their members to lodge issues on their behalf through the UPC otherwise companies and business enterprises can submit their issues directly through the UPC.

  • Upon receiving an issue for consideration, the issue, if determined as bona fide, will be assigned to one of the several PEMUDAH Technical Working Groups (TWGs) for action. The TWGs’ terms of reference are based on a specific group of economic activities such as Dealing with Construction Permits or Paying Taxes. Each TWG is co-chaired by a secretary general or a director general of a government ministry or agency and a leading private sector business leader. TWGs will study an issue in-depth in consultation with stakeholders from both the public and private sectors including the stakeholder that submitted the issue. The best solution for the issue is worked out in these consultations and related meetings. Contentious issues difficult to be resolved can be referred to a higher level which is the PEMUDAH Private Sector meeting for further deliberation and, subsequently, if deemed appropriate, the issue and major issues of far-reaching importance and their proposed solutions will be escalated up to a PEMUDAH meeting co-chaired by the Honourable Minister in the Prime Minister’s Department (Economy), the Chief Secretary to the Government and a private sector business community leader for direction. The essence of the PEMUDAH issue resolution mechanism rests on public and private sector collaboration to ensure regulations are not more than necessary.

  • Each issue received by PEMUDAH will be comprehensively and objectively examined by the PEMUDAH Secretariat initially. If unnecessary regulatory burden on the doing of business is determined or if business efficiency, productivity, growth, sustainability or competitiveness is determined to be adversely affected, the work process is commenced in a Technical Working Group to seek out a solution by way of public-private sector collaboration. PEMUDAH and TWG Members are fully committed to identify the root causes of issues and seek out their solutions as reflected by the many regulatory burden- and government policies-related issues resolved ever since its establishment in 2007 by the Government.

  • Foreign-owned or operated businesses are also part of the general business ecosystem in Malaysia and can seek assistance from PEMUDAH as the taskforce supports the Government’s initiatives to promote greater inflows of foreign direct investments into Malaysia to spur economic growth and development.

  • PEMUDAH does not impose any service fees or processing fees. PEMUDAH Members and the members of its Technical Working Groups are involved in issue resolution and pursue improvement initiatives purely on a pro bono basis to advance trade, industrial and national interests.

  • PEMUDAH does not maintain any branch offices in Peninsular Malaysia or in Sabah and Sarawak. The MPC regional offices provide supporting services to PEMUDAH-sponsored programmes, events and other activities in their regions. The State Governments of Pahang Darul Makmur and Sarawak had established PEMUDAH Pahang and SAMUDAH respectively to address their state-level issues independently from PEMUDAH but close collaboration exists between PEMUDAH, PEMUDAH Pahang and SAMUDAH.

  • MIDA updated the ICA10 Guideline (w.e.f. 12 May 2022) under the Online Application Section at the MIDA’s website. This updated guideline indicated that companies exempted from the Manufacturing Licence as confirmed through the Exemption Letter are eligible to apply various facilities accorded by the Government such as Import Duty Exemptions for Machinery and Equipment under the Customs Duties (Exemption) Order 2017 and Sales Tax (Person Exempted from Payment of Tax) Order 2018; as well as Investment Incentive under the Promotion of Investments Act, 1986 and Income Tax Act 1967 subject fulfilling the required criteria and condition.

  • Q:

    The calculation of Population Equivalent (PE) by Indah Water Konsortium (IWK) has fewer benefits to the industry, especially for hoteliers. How PE is being calculated and what is the way forward to improve the PE rate to ease hoteliers’ concerns?

    A:

    The PE is an estimate of the usage made of sewage facilities. It is not a measure of population. For residential areas, the population equivalent is calculated as five per dwelling and is a direct measurement of the population in an area.

    However, for commercial areas, it is calculated from the floor area, which is proportional to the number of people using the premises during the day. In this case, it does not reflect the population living in an area.

    IWK and SPAN are aware of the business concern for this PE rate. Thus, SPAN is currently reviewing the revised PE rate. Engagement with the stakeholders is actively conducted by SPAN for this matter.
